By accessing or using our website, services, or engaging with our credit repair and business funding services, you agree to be bound by these Terms. Our services are provided for a fee, which will be disclosed to you before you commit to using our services. Payment terms, schedules, and methods will be communicated during the onboarding process.
Refund Policy: Refunds are provided in accordance with the Credit Repair Organizations Act (CROA) and applicable state laws. You may cancel services within three (3) business days of signing the contract for a full refund. After this period, refunds will be evaluated on a case-by-case basis.
Late Payments: Failure to make timely payments may result in suspension or termination of services. We reserve the right to charge late fees or interest on overdue accounts.
BES complies with the Credit Repair Organizations Act (CROA), 15 U.S.C. § 1679 et seq. Under CROA, you have the right to:
We do not guarantee specific results or improvements to your credit score. Results vary based on individual circumstances, credit history, and cooperation with the credit repair process.
No Guarantees: While we work diligently to improve your credit score and secure business funding, we cannot guarantee specific outcomes. Credit improvement depends on many factors, including the accuracy of information, creditor responses, and your financial behavior.
Service "As Is": Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
Limitation of Liability: To the fullest extent permitted by law, BES shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.
All content on our website, including text, graphics, logos, images, software, and other materials, is the property of BES or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our express written permission.
We maintain strict confidentiality of all client information in accordance with applicable privacy laws and our Privacy Policy. We will not disclose your personal or financial information to third parties except as necessary to provide our services, comply with legal obligations, or with your explicit consent.
Either party may terminate this agreement at any time:
Upon termination, all licenses and rights granted to you will immediately cease, and you must stop using our services.
Informal Resolution: In the event of any dispute, claim, or controversy arising out of or relating to these Terms or our services, the parties agree to first attempt to resolve the dispute informally by contacting us at info@bizenhancers.com.
Binding Arbitration: If informal resolution is unsuccessful, any dispute will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration will be conducted in the state where BES is headquartered, and judgment on the arbitration award may be entered in any court having jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which BES operates, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within that state for the purpose of litigating any disputes.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.
These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and BES concerning our services and supersede all prior agreements and understandings.
